Kanu’s Lawyer Reveals Next Action As FG Objects To Court Order Releasing Kanu

As the FG objects to the court order releasing Kanu, Kanu’s attorney reveals the next course of action

Chief Mike Ozekhome, SAN, the primary attorney for Nnamdi Kanu, has advised the Federal Government to follow the Appeal Court’s ruling and permit Mazi Nnamdi Kanu to return home.

If the judgment is obeyed, he claimed, it will bring peace to the Southeast.

Mazi Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), was released and found not guilty by an Abuja Appeal Court on Thursday after Kanu’s attorneys had appealed the case.

Nnamdi Kanu was dismissed, not acquitted, according to the Federal Government, which was represented by Attorney-General of the Federation and Minister of Justice Abubakar Malami. Malami made a declaration.

Parts of the statement read;

“Let it be made clear to the general public that other issues that predates rendition on the basis of which Kanu jumped bail remain valid issues for judicial determination.

“The Federal Government will consider all available options open to us on the judgment on rendition while pursuing determination of pre-rendition issues.”

Reacting to Malami’s statement, Ozekhome said in an interview on Channels Television that he will file a cross-appeal on some issues he doesn’t agree with the Court of Appeal on, should the Federal Government go on to appeal the judgement of the Appeal Court.

According to Ozekhome, the law clearly states that a person can only be tried when the place and time a crime was committed has been established. And in the case of Nnamdi Kanu, the Federal Government stated that Nnamdi Kanu made a broadcast but didn’t say where he made the broadcast. Ozekhome said that Appeal Court overlooked this part.

Jubilation In Eziama Afara Ukwu Ibeku Over Nnamdi Kanu’s Victory

Nnamdi Kanu’s home community of Eziama Afara-Ukwu in Umuahia, which received the news of his acquittal by the Court of Appeal, Abuja, on Thursday, exploded in celebration.

Since October 2015, Mr. Kanu, the head of the Indigenous People of Biafra (IPOB), a group that is prohibited, has been on trial for suspected treasonable crime and other accusations.

In April 2017 after spending 18 months in custody, he was given bail.

He, thereafter, fled the country after soldiers attacked his Umuahia residence during a military operation, code-named Operation Python Dance, targeted at the proscribed IPOB.

He was, however, re-arrested in June 2021 in Kenya and extradited to the country to resume his trial.

The IPOB leader was remanded in the State Security Service custody until the court discharged him on Thursday.

The News Agency of Nigeria (NAN) reports that youths, men, women and children of his community trooped out to Mr Kanu’s family house in ecstasy when news about his discharge broke out.

The shouts of “Owo-woo”, a common refrain in celebrating and rejoicing over a pleasant and remarkable development in Igboland, rented the atmosphere.

Chief Mike Ozekhome (SAN), counsel for the leader of the Indigenous People of Biafra, Nnamdi Kanu, has appealed to the President, Major General Muhammadu Buhari (retd.), to immediately release Kanu from detention through a ‘political solution.’


In a petition dated October 3, 2022, a copy of which was made available on Tuesday, the lawyer urged Buhari to order the immediate release of Kanu by instructing the Attorney General of the Federation to wield his powers under Section 174 of the 1999 Constitution to enter a “nolle prosequi.”

According to him, the appeal is to enable Buhari to correct a long-standing travesty of the continued detention of Kanu by the Nigerian Government under cruel, inhuman and degrading conditions.

He noted that Kanu is currently standing trial at the Federal High Court for sundry offences, for which he was granted bail and he observed the terms and conditions of the bail until he was attacked by the men of the Nigerian Army.


He said, “It (the attack) was a state-sponsored assassination attempt on his life. As if that was not bad enough, Kanu’s subsequent sojourn in exile to seek refuge in London from where he travelled to Kenya, was brutally aborted on June 26, 2021, when he was savagely abducted, blindfolded, tortured and kept in solitary confinement for eight days in a secret location and forcibly brought back to Nigeria.

“This was carried out arbitrarily without due process and recourse to the judicial systems of Kenya, the UK and Nigeria.

“In Kenya, Kanu was tortured and made to disappear and kept out of circulation and public view in a secret facility for eight days by Kenyan authorities. It was an illegal collaboration between the Kenyan and Nigerian secret agents.”

Ozekhome argued that Kanu’s continued detention violates all known laws and norms of both international and domestic laws, including Nigeria’s obligations under binding international treaties.

He added, “Kenya did not reply to the 16-page report that indicted both the Nigerian and Kenyan governments for Kanu’s arrest and extraordinary rendition, torture and continued detention.

“The UN Council urged the Nigerian government to ensure the immediate release of Kanu unconditionally. It was also ordered that he should be paid adequate compensation for the arbitrary violation of his fundamental human rights.

“The point must be emphasised that Kanu had travelled to Kenya using a British Passport. He has thus presented himself to the Kenyan authorities as a British citizen, and not a Nigerian citizen, or one with dual citizenship of Nigeria and the UK.

“To refuse to release Kanu unconditionally and immediately is to court international displeasure and the multi-faceted backlash, it will hurt Nigeria badly as it will also insinuate that Your Excellency does not subscribe to the rule of law and respect for citizens’ fundamental rights, and your postulations of the just ended United Nations General Assembly which took place between September 20 and 23, 2022.

“Your Excellency must avoid these unhealthy reactions by ensuring that Kanu is released immediately and unconditionally now. The moral burden of insisting on keeping Kanu in detention is too expensive and too offensive to embrace, especially with his fragile and deteriorating health condition which his custodians, the State Security Services, have not been able to manage properly. Do not let Kanu die in detention.

Ifeanyi Ejiofor, a lawyer for Nnamdi Kanu, has stated that his client, the leader of the outlawed Indigenous People of Biafra (IPOB), is experiencing a rapid decline in health.

Since his arrest and subsequent extradition to Nigeria, Kanu has been held in custody by the DSS for more than 14 months at this point. He is being tried for the heinous crime of treason.

Ejiofor said in a statement that was released on Monday that Kanu has been denied access to his personal physician on multiple occasions in order to determine his current state of health.

“For the records, it is pertinent to reiterate that for the umpteenth time, the lawless DSS has continued to treat with greatest contempt/disdain, the existing court order, which specifically directed that Onyendu should be allowed access to his personal medical doctor for an independent review/investigation of his current health status,” the statement reads.

“This is following the continued depletion of his potassium level.

“Regrettably, this court order is gravely flouted with impunity by the DSS, as efforts made by Onyendu’s personal doctor to see him at the DSS facility where Onyendu is currently being detained were rebuffed/rejected by the DSS.

“Presently, Onyendu is experiencing [gastrointestinal] disorder, which requires regular intake of antacid and other availing medical solutions, following persistent heartburn.


“Unfortunately, the DSS has denied him the least of the prescribed painkiller tablets that could provide momentary relief.

“Following this development, our erudite lead counsel, Chief Mike Ozekhome, SAN, has immediately swung into action to ensure immediate end to this maltreatment and impunity.

“Nevertheless, we still deem it compelling to place the world on notice, that should anything untoward happen to Onyendu, the DSS and the federal government of Nigeria should be held responsible.

“Orders of the court must be obeyed, particularly where the order has not been set aside. The DSS is a creation of the law and must not be seen to be operating above the laws of the land that created it.
“Enough is enough of this seeming impunity!”

A budding singer, Agada Obutu, aka Berri Tiga, has said he does not like the fact people don’t give him credit for singing the hit song titled, ‘Machala’, which he was featured on by an Instagram comedian, Carter Efe.

In an interview with Saturday Beats, the singer said, “The song is actually a collaboration (between me and Carter Efe), but I don’t like the fact that people are not giving me accolades for it. People don’t know that I sang the song.”

Tiga, however, admitted that there was no proper arrangement between him and Efe on earnings and credit for the song. He said, “We did not really have a proper agreement. We made the song on the same night we posted it online, and it ‘blew up’ on TikTok. My management asked me what our agreement was, but Efe’s management said they were the ones promoting the song, and they would not give me any royalty on it.”

Tiga also claimed that he was initially told that he could not perform the song. He said, “Initially, they sent me an agreement that I could not perform the song, but when I spoke to them about it, they said it was a mistake.”
The singer also maintained that he had nothing to do with the song been taken down from some digital platforms. He said, “I am aware that the song was taken down from some platforms, but I don’t know how it happened.”

Tiga added that he was not fighting with Efe over who owned the song but was just responding to a comment asking if he was the producer of the song. He said, “I just want people to know that I am not fighting with Efe over who owns the song. I just replied to a comment, when somebody asked if I was the producer of this song. I responded that I sang the song, and am not a producer.”

On whose idea it was to compose the song, Tiga said, “He (Carter) called me one night, and said we should do something on Wizkid (who is also known as Machala), and post it online. He sent me a beat that was copyrighted, and I told him that we could not use it. I then told my producer to create a beat, and we recorded the song.”
